CAPITAL UNITED Soccer Club Discipline Procedures

Version 1.0 - May 2003

 

1. Scope

These procedures cover discipline resulting from actions within the CAPITAL UNITED House League play.  It also deals with any incident associated with CAPITAL UNITED and its players, coaches, managers, directors, and parents based upon transgressions of the CAPITAL UNITED or EODSA/OSA Rules and Regulations (including those covering Volunteer Screening/ Harassment violations).

 

CAPITAL UNITED shall observe OSA and EODSA Policies and Procedures  in the application of discipline procedures within its House League(s). 

 

2. Discipline Notification

A “CAPITAL UNITED Discipline Report” (Appendix A) must be submitted as described below in Section 3 when a rule has been or deemed to have been transgressed.  These allegations will be handled through the Discipline by Review or Discipline by Hearing processes described below. This report shall be delivered in writing to the Club President or a member of the executive.

 

2.1 Field of Play Discipline

It is the responsibility of game officials, CAPITAL UNITED Head Referee, coaches, HL Coordinators, Club Executive or other persons designated by the club to submit an “CAPITAL UNITED Discipline Report” when a card is used in a match or if a player, coach or parent is sent off the pitch for a breach of discipline. 

 

2.2 Complaints

A complaint against a player, coach, referee, or parent must be forwarded to the CAPITAL UNITED.  The club will then review the complaint and determine if it is within the realm of its responsibilities to take action.  The club may only take action if the complaint falls within the Discipline listed below or from the club “Constitution” or club “Rules and Regulations”.  The CAPITAL UNITED must forward all referee complaints to the District.  If the Club or District,following up on a formal complaint, determines that a hearing is warranted then the author of the complaint will be required to attend the hearing.  Should the author of the report refuse to attend a Discipline Hearing then the Hearing will not take place.

 

3. Infraction Handling Processes

3.1 Infraction Involving Game Officials

CAPITAL UNITED recognizes that it does not have jurisdiction over incidents involving game officials.  All of these types of incidents will be referred to the EODSA who will handle these on behalf of the OSA.  CAPITAL UNITED is bound by all rulings of the OSA.  This is compliant with OSA policies 10.2.1 or 3.5 (2003 version).

 

Players, Coaches or Club officials suspended for Game Official Assault will be fined the amount the Administration Fees charged to the club by the EODSA/OSA ($200.00 in 2003).  Until this fee is paid a Player, Coach or Club Official will be denied services of the club (i.e., you can’t play, you can’t coach).

 

If you have committed Game official Assault you are automatically suspended from all soccer related activity.  You would be contacted by either or both your Club and /or the District notifying you of such.   Please note that if you are suspended from all soccer related activity you cannot participate in any soccer activities under the realm of the OSA.  This includes administering, practicing, coaching, playing, officiating, or any other activity related (directly or by proxy) to soccer under the OSA guidelines.

 

3.2 Infractions Handled by Discipline by Review (DBR)

CAPITAL UNITED will deal with the discipline situations below listed using OSA “Discipline by Review” (DBR) procedures as adapted for CAPITAL UNITED.

A discipline hearing shall be conducted and the appropriate discipline shall be rendered.

 

3.2.1 DBR Procedures

CAPITAL UNITED DBR shall follow OSA rules and policies and their procedures for the convening and conducting a review.  This includes:

1)      CAPITAL UNITED will use the Notice of Hearing with Findings and Decision to record the disposition and notifications associated with a DBR result.

2)      CAPITAL UNITED will use additional OSA forms where necessary

3)      Rights of Appeal Information if appropriate.

CAPITAL UNITED will ensure that the Review Panel does not include any party involved in the incident reported in the complaint or infraction.

 

3.3 Discipline Handled by Discipline by Hearing (DBH)

3.3.1 DBH Offences

CAPITAL UNITED will deal with the situations listed below using OSA “Discipline by Hearing ” (DBH) procedures as adapted for CAPITAL UNITED.  Note that serious infractions referred from above will also be handled by this process.

3.3.2 DBH Procedures

CAPITAL UNITED DBH shall follow OSA rules and policies and their procedures for the convening and conducting a hearing.  This includes:

1)       Notice of Discipline Hearing – written submission with prior notice via phone or e-mail, signed receipt in personal delivery

2)      CAPITAL UNITED will use the Notice of Hearing with Findings and Decision to record the disposition and notifications associated with a DBH result.

3)      CAPITAL UNITED will use additional OSA forms where necessary including Hearing Waiver

4)      Rights of Appeal Information.

CAPITAL UNITED will ensure that the Hearing Panel does not include any party involved in the incident reported in the complaint or infraction process.

 

3.4 Details about Suspensions

Suspensions begin only when officially notified in writing by the CAPITAL UNITED Soccer Club (or EODSA, as the case may be).  In the case of game suspensions, CAPITAL UNITED notification will specify which games are subject of the suspension and only those named games will count towards meeting the disciplinary action.

 

Please note that the Game official Assaults entail an automatical suspension from all soccer related activity as defined by OSA rules and terminology.  Both the Club and District will provide notification in such cases.

 

Please note that if you are suspended from all soccer related activity you cannot participate in any soccer activities under the realm of the OSA.  This includes direct or indirect (by proxy) administering, practicing, coaching, playing, officiating, or any other activity related to soccer under the OSA guidelines.

 

4. Notice Distributions

The CAPITAL UNITED Discipline Panel will provide timely notification to the HL Coordinator, Coaches, CAPITAL UNITED Head Referee, Parents and Players as to their status for eligibility to play.

 

It is the collective responsibility of Parents, Players, Coaches, HL Coordinators, the CAPITAL UNITED Discipline Panel and CAPITAL UNITED Executive to validate and maintain records of accumulated offences.

 

5. Rights to Appeal

Decisions taken by the CAPITAL UNITED Discipline Panel in situations of DBH or CAPITAL UNITED Panel discipline decisions (Play or Club) are subject to the right of appeal to the next level of Appeal as appropriate:

 

-Decisions of the CAPITAL UNITED Discipline Panel on HL Play or Club Rules and Regulations can be appealed with the CAPITAL UNITED Executive Committee.

 

-Decisions of the CAPITAL UNITED Executive Committee on discipline matters (Play or Club) can be appealed with the EODSA.

 

Appeals will only be granted when there is:

1)       New facts that were not available when the discipline decision was made;

2)      Specific procedural errors alleged in arriving at the decision;

3)      Alleged incorrect interpretations of Published Rules; or

4)      Alleged excessive fine, fee, bond or suspension.

 

A “Letter of Appeal” must be submitted identifying the specific rationale for the appeal. The disciplinary action being appealed remains in place, unless otherwise notified, until such time as the appeal process is concluded. In the case of an appeal lodged with the CAPITAL UNITED Executive Committee, the Committee will ensure that the process is expedited to reduce waiting time. In the case of an appeal lodged with EODSA, the appeal process will follow the timelines as prescribed by EODSA rules and procedures.
